Ordinance No. 1709

AN ORDINANCE ENTITLED: AN ORDINANCE AMENDING SECTION 5 AND SECTION 6 OF ORDINANCE NO. 1686 OF THE CITY OF HOPE, ARKANSAS

WHEREAS, THE Board of Directors of the City of Hope, Arkansas passed and approved the City of Hope Purchasing Ordinance No. 1686 on December 15, 2020; and,

WHEREAS, after implementation of Ordinance No. 1686, Arkansas State Law increased the maximum dollar limit cities could spend on goods, services and building projects without competitive bidding; and,

WHEREAS, it has now been determined that Section 5 and Section 6 of Ordinance No. 1686 should be amended to reflect current Arkansas law;

NOW, THEREFORE BE IT ORDAINED by the Board of Directors of the City of Hope, Arkansas:

SECTION 1: Section 5 of Ordinance No. 1686 is hereby amended to read as follows:
"Section 5: Purchases exceeding $10,000 but not exceeding $35,000:
The purchase of goods and services exceeding $10,000, but not exceeding $35,000 requires three written quotes from potential vendors and a written purchase order approved by the City Manager prior to purchase."

SECTION 2: Section 6 of Ordinance No. 1696 is hereby amended to read as follows:
"Section 6: Purchases requiring Competitve Bids:
Per ACA 14-58-303 and ACA 22-9-203, the following purchases require competitive bidding:
1. Goods and services in excess of $35,000
2. Public improvements inclusive of major repairs, alterations, or the erection of any building or other structures in excess of $50,000."

Section 3: Section 7 of Ordinance No. 1686, entitled "Competitive Bid Process", is hereby amended to add item eight (8) to the current list of seven (7) items. The following is added:
"8. Unless otherwise required by law, in general, public notice for competitive bids shall occur by advertising one (1) time each week for two consecutive weeks in a local public news media of general circulation. Any deadline for bid submission and or bid opening will occur no less than 1 week from final advertisement. The advertisement will include but is not limited to: the dates, times, and location for submiss of bids; that bids must be sealed; complete instructions for any method of bid submission allowed such as personal delivery, mail/parcel and or electronic media; instructions for obtaining bid specifications and other bid documents if applicable; date and time of bid closing, date, time and location of bid opening and public reading of bids; the name, phone number and address of a point of contact for further information; and a statement that the City of Hope reserves the right to reject all bids."
