The three ordinances were as follows:
· Approving a reimbursement from the state of Arkansas for $10,812.09 for the cost of elections incurred by Nevada County.
· Approving the receiving from the state of Arkansas of a courthouse security grant of $5,101.50 and appropriating that amount for upgrading protective measures at the Nevada County Courthouse.
· Renewing of previously passed county property taxes. This ordinance specifies and reaffirms millages being collected. A copy of this ordinance is provided below this story.
· Amending the ordinance establishing and setting rules for a system of solid waste collection. The changes included come as a result of the Nevada County voters passing a ¾-cent sales tax. A copy of the ordinance is provided below this story.
Also during the meeting Eighth District North Prosecutor Ben Hale explained that he and Stayton had agreed on an arrangement whereby Stayton will provide legal advice to the quorum court.
County Emergency Services Officer David Gummeson told the court FEMA reimbursements for the county’s costs of dealing with recent storm damage will be delayed several weeks due to the over a month-long federal government shutdown.
Concerning county roads, County Judge Mike Otwell said culverts and gravel had been used to repair CRs 3 and 7. JP Patricia Grimes reported Cale Road was causing flats.

BE IT ENACTED BY THE QUORUM COURT OF THE COUNTY OF NEVADA OF THE STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED:
AN ORDINANCE TO AMEND ORDINANCE 20-1, “AN EMERGENCY ORDINANCE ESTABLISHING A SYSTEM OF THE COLLECTION AND DISPOSAL OF SOLID WASTE IN NEVADA COUNTY, ARKANSAS, ESTABLISHING CERTAIN PROCEDURES AND FEES FOR SUCH SERVICE, REQUIRING PARTICIPATION IN THE SYSTEM, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES.”
WHEREAS, a ¾ cent sales tax was approved by the voters of Nevada County;
WHEREAS, the projected revenues are sufficient to cover the cost of providing the service of permitted solid waste collection within Nevada County beginning January 1, 2026;
WHEREAS, changes recommended by Arkansas Legislative Audit to this Ordinance have been held in abeyance until the approval of the sales tax;
NOW, THEREFORE, BE IT ORDAINED BY THE QUORUM COURT OF THE COUNTY OF NEVADA, STATE OF ARKANSAS, THAT:
ARTICLE 1.
For the purposes of this Ordinance, the following definitions shall apply:
(a) Construction or Maintenance Waste: A type of Prohibited Solid Waste more particularly described as all vegetation, leaves, limbs, tree trunk, grass, debris and waste construction or maintenance materials, including earth, rock, concrete plastics, and metal derived from the construction, or the partial or total demolition, of buildings, or roads or other structures, or maintenance relating thereto.
(b) Container: A receptacle designed for collection of Permitted Solid Waste specifically designated or approved by the County Judge and/or his designee for use in the System.
(c) County Judge: The County Judge of Nevada County, Arkansas.
(d) Hazardous Waste: A type of Prohibited Solid Waste more particularly described as waste or combination of wastes of solid, liquid, contained gaseous or semi- solid form, which because of its quantity, concentration, or physical chemical or infectious characteristics, may cause or significantly contribute to an increase in mortality or an increase in serious irreversible or incapacitating reversible illness, or pose a substantial present or potential hazard to human health or of the environment when improperly treated, stored, transported, disposed of, or managed.
Such wastes include, but are not limited to chemical wastes, herbicide waste, pesticide wastes and those which are radioactive, toxic, corrosive, flammable, irritants, strong sensitizers, or which generate pressure through decomposition, heat or other means.
(e) Person: Any individual, corporation, company, firm, partnership, association, trust, state agency, government instrumentality or agency, institution, county, city, town of municipal authority, trust, venture or other legal identity, however organized.
(f) Permitted Solid Waste: All ordinary garbage or rubbish, including paper, plastic, cardboard, tin or aluminum cans, glass, and crockery, which is generated by or results from the normal activities of Persons unless the same constitutes Prohibited Solid Waste.
(g) Prohibited Solid Waste: All solid waste which constitutes Construction or Maintenance Waste, Specially Handled Waste, Hazardous Waste, Special Waste and all other solid and semi-solid waste materials resulting from industrial, commercial, agricultural, or community activities.
(h) Quorum Court: The Quorum Court of Nevada County, Arkansas.
(i) Special Waste: A type of Prohibited Solid Waste more particularly described as solid waste that, due to its special nature, requires or allows special treatment with regard to its disposal and will include, but not limited to, solidified sludge, spent herbicide container, condemned food products, incinerator residue, vehicle tires, and dead animals.
(k) Specially Handled Waste: A Type of Prohibited Solid Waste more particularly described as solid waste that requires special handling or special equipment for the proper disposal and will include, but not be limited to household appliances, freezers, refrigerators, coolers, vending machine, air conditioners, heaters, lawn mowers, garden implements, sofas, mattresses, bed springs, stoves, bicycles, motor vehicles, motor bikes, boats, large tables, desk, water heaters, lumber, roofing material, wire, sheet rock, and demolition waste.
(l) System: The Permitted Solid Waste collection and disposal system established by this Ordinance consisting of a system of collection from Users. This System may be referred to as the Nevada County Solid Waste System.
(m) User: Any Person that presents Permitted Solid Waste for collection within the System.
ARTICLE 2.
The county hereby establishes a county wide system for collection of Permitted Solid Waste for transportation to its designated landfill.
ARTICLE 3.
(a) Only Permitted Solid Waste may be placed for collection. All Permitted Solid Waste shall be placed in plastic bags designed for the containment of Solid Waste, and each such bag shall be fully and properly sealed to prevent the spillage on the contents thereof. Such bags may be further placed within a Container provided by the User.
(b) It is the responsibility of the User to place all Permitted Solid Waste at a pick-up location designated by the County Judge or his/her representative and within eight (8) feet of the curb or edge of the public road at which it is to be picked up and readily accessible for collection at such place.
(c) The User shall place the Permitted Solid Waste at the pick-up location one-day prior to the designated pick-up day and time.
(d) The User shall not place the Permitted Solid Waste for pick-up within a closed or locked fence nor in the vicinity of any dangerous animal.
(e) Permitted Solid Waste that is not properly bagged and placed as required in this Ordinance shall not be picked up.
(f) The rules and procedures for the collection of the placement of Permitted Solid Waste shall be prescribed by the County Judge.
ARTICLE 4.
(a) Prohibited Solid Waste is prohibited from being placed for pick-up by the System, unless prior authorization has been obtained from the County Judge and a fee set be the County Judge has been paid therefor.
(b) No Person shall place Permitted Solid Waste for pick-up at any location except where so designated by the County Judge or his/her designee.
(c) No Person shall move, disturb, deface, destroy, burn or otherwise tamper with any Permitted Solid Waste placed for pick-up or any Container.
(d) No Person shall remove any Permitted Solid Waste from any Container which is not owned by that person, except for persons employed by the System or a contractor for the System.
(e) No Person shall get inside any Container that is not their personal property, except for persons employed by the System or a contractor for the System.
(f) No Person shall search through any Container which is not their personal property or remove the contents thereof, except for person employed by the System or a contractor for the System.
ARTICLE 5.
The County Judge may by Order adopt additional procedures and may implement policies which are necessary or incidental to the implementation of the System; however, any such procedures or policies may be amended by the Quorum Court.
ARTICLE 6.
Prohibited Solid Waste may be handled only by special handling approved by the County Judge and/or his designee.
ARTICLE 8.
(a) Any person who commits a prohibited act as prescribed by this Ordinance or who fails to perform an act required by this Ordinance, shall be guilty of a misdemeanor and shall be fined an amount of not less than one hundred dollars ($100) and not more than five hundred dollars ($500) for each violation. Each day or part of a day during which a violation is continued or repeated shall constitute a separate offense; however, in such case, the fine for the first day of the offense shall be as set forth in the preceding sentence and the fine for the second and each later day of the offense shall not exceed two hundred fifty dollars ($250).
(b) In addition to the fine described in the preceding subsection, or in lieu thereof, the sentencing body may require such person to remove and clean up, without renumeration, the solid waste for which the person was responsible.
(c) Any person found guilty of any provisions of this ordinance, may be in addition to the preceding penalties or in lieu thereof, be required to assist, without renumeration, the County in the clean-up of litter in the County.
ARTICLE 10.
If any provisions of the Ordinance, or the application thereof to any person or circumstances, is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provisions or application, and to this end provisions of this Ordinance are declared to be severable.
ARTICLE 11.
The effective date of this amendment shall be January 1, 2026.
