LITTLE ROCK – Arkansas Attorney General Leslie Rutledge today announced a lawsuit against David Tyler, who conducts business as Tyler Pools & Construction, of Fayetteville, for violating the Arkansas Deceptive Trade Practices Act (ADTPA). The complaint alleges homeowners paid over $148,000 to Tyler for pool construction. The projects were never completed, and frustrated customers who inquired as to their projects’ status often found themselves facing Tyler’s threats to inflict physical harm upon them. In October 2020, Tyler was issued a license to operate another pool company, Custom Care Pools. However that license was revoked in May 2021 for misconduct.

“Many of the Arkansas families duped by Tyler saved their money for years to have their dream pool,” said Attorney General Rutledge. “Tyler conned families out of thousands of dollars, only to wreck their yards, leaving dangerously large and empty holes in the ground.”

Attorney General Rutledge’s complaint alleges that the defendant knowingly made false representations to consumers, claiming that Tyler would install the pools; however, after obtaining money from customers, construction would cease on the projects, leaving many Arkansans with nothing more than holes in their backyards. Tyler violated the ADTPA when he lied to consumers by saying that he was licensed through the Arkansas Contractors Licensing Board when he was not. Tyler was also not registered to do business with the Arkansas Secretary of State.
